Investigation launched after black barrister mistaken for defendant three times in a day

England and Wales courts head apologises after Alexandra Wilson describes having to ‘constantly justify existence’

The head of the courts service in England and Wales has apologised to a black barrister after she was stopped and mistaken for a defendant three times in one day at court.

Kevin Sadler, the acting chief executive of HM Courts and Tribunals Service, has condemned the “totally unacceptable behaviour” and promised to investigate the complaint made by Alexandra Wilson, who specialises in criminal and family cases.

Wilson, whose chambers are near the Old Bailey in the City of London, tweeted this week that she had gone to a court and was repeatedly misidentified as a defendant rather than as a lawyer. She is the author of In Black And White, which highlights the problem of racism in the courts.

Wilson said that she was “absolutely exhausted” after what had happened and that “a light needs to be shone on this”. Her tweets triggered fresh accusations about racism in the courts.

Wilson said she had initially been stopped at the entrance by a security guard and “asked me what my name was so he could ‘find [my] name on the list’ (the list of defendants)”. She thought that might have been an “innocent mistake”.

Then a member of the public, who thought she was a journalist, told her not to go into a courtroom and to wait for the usher to sign her in for her case. She had to explain that she was the barrister.

Inside the courtroom, a barrister or solicitor told her to wait outside and see the usher. Wilson explained that she was a lawyer.

Prediction: At some point in the future she will be a criminal defendant.

I have no idea what for, and I certainly will not prejudge her for something that has not happened yet.

But it's too perfect a plot twist for it not to happen. :)

Government accused of ‘beyond laughable’ hypocrisy for launching campaign urging other countries to obey rule of law

Government has repeatedly broken both domestic and international law

The government has been accused of "beyond laughable" hypocrisy for running a campaign extolling the virtues of democracy and the rule of law to other countries – after appearing to repeatedly undermine them itself.

The #BeHeard campaign, launched Foreign Office, names "independent judges free to uphold the law" as a key element of democracy, alongside protecting the rights of minorities and allowing “the press to challenge those in power and to shine a light where it is needed most”.

But ministers were accused of "saying one thing whilst doing another" in launching the campaign, given that they openly admit that they are planning to break international law with new legislation – and have faced a string of criticisms for their approach to democracy, the rule of law, and judicial independence

Last year Boris Johnson's move to unilaterally suspend parliament to force his Brexit policy through against the elected chamber was found to be unlawful by the Supreme Court.

The court unanimously ruled that the prorogation should never have taken effect and said the government was "preventing or frustrating without reasonable justification" the ability of parliament to carry out its functions.

Judge Lady Hale describe the move as a “prolonged suspension of parliamentary democracy" with an “extreme” effect on “the fundamentals of our democracy”.

This year the government used its Whitehall public relations channels to launch an attack on "activist lawyers" defending migrants in legal cases; it has also been subject to a number of alerts from the Council of Europe for measures or policies that might harm freedom of the press.

In 2016 the government-supporting newspaper the Daily Mail branded three judges "enemies of the people" for ruling against ministers in a key legal case, publishing mug-shot style photographs on the front page.

There were reports this weekend that the government wants to appoint the Mail's then editor Paul Dacre to head regulator Ofcom.

Commenting on the new campaign Lisa Nandy, Labour’s shadow foreign secretary said: “Just when you thought 2020 couldn’t get any more bizarre, the Foreign Office has just launched a campaign against itself.”

Bars and pubs across Britain ban MPs until 10pm curfew is lifted

Bars and pubs across the country are campaigning against the new 10pm curfew as of this week. Some are even going so far as to ban MPs from their premises until the restrictions are lifted.

All hospitality venues must now shut at 10pm, according to a new rule which came into effect in England last Thursday (September 24). Introduced as a bid to slow the spread of coronavirus, which has been recently spiking in England, the rule has faced huge backlash from venues who have already been pushed to breaking point by the pandemic.

In response, over 1200 bars came together to launch the #CancelTheCurfew campaign on Monday, September 28, aimed at pressuring the government to revoke the new rule.

The campaign was originally planned in Facebook bar groups around the UK, specifically in Leeds, Sheffield and Manchester, but has quickly gained traction in venues of all stripes.

Government faces legal challenge over 5G phone masts 'safety fears'

The government’s rollout of the 5G mobile network is facing a High Court legal challenge amid safety fears around the new generation of phone masts.

Ministers announced in July it was relaxing planning permission requirements for the extension and upgrade of phone masts around the country, to accelerate the implementation of the 5G network.

Today, a judicial review was launched into that decision, challenging the consultation carried out, accusing civil servants of withholding key scientific data from ministers before the decision was made, and claiming that safety fears around 5G masts have not be allayed.

Among the parties to the legal challenge is Phillip Watts, a retired engineer and trustee of the EM Radiation Research Trust, who says his health has suffered from living close to a phone mast.

“While there is so much concern around health issues associated with 5G infrastructure, it cannot be right to give mobile phone companies carte blanche to invade our cities, towns, communities and residential streets with controversial technology," he said.

The legal claim was lodged today by law firm Learmond Criqui Sokel, with top barrister David Wolfe QC due to lead the court challenge.

It is claimed the Housing, Communities and Local Government and Digital, Culture, Media and Sport departments did not conduct a proper consultation on the decision to relax planning permission requirements on 5G masts.

Campaigners say at least 400,000 masts are due to be installed as the 5G network is expanded, and they claim pre-claim correspondence with the government shows an “entire body of detailed, cross-referenced and evidenced scientific material” on radiation and possible health impact of masts was kept from ministers.
