The bill, called the Algorithmic Accountability Act and introduced last month by Senator Ron Wyden, Senator Cory Booker and Representative Yvette D. Clarke, is a good start, but it may not be robust enough to hold tech companies accountable.

Because algorithmic models are incredibly complex, it can be hard for even their designers to know exactly how outcomes come about. But it’s possible to study their design and anticipate their results.

The bill is a meaningful first step in addressing the problems with algorithmic decision-making. Companies must be pushed to consider and document what goes into algorithm design. They should be pushed, too, to come up with solutions. But the bill is lacking in three main areas.

First is enforcement. The bill largely relies on the agency responsible for consumer protection, the Federal Trade Commission, to issue and enforce regulations about what should be in companies’ impact assessments. The bill grants the F.T.C. new enforcement powers, including the power to require companies to “reasonably address in a timely manner the results of the impact assessments,” but the agency even now too rarely enforces its settlements with repeat privacy violators. Significantly, the bill does not clearly prohibit algorithmic bias or unfairness. It relies instead on the F.T.C. to do so, or on penalties set by existing consumer protection and discrimination law, which may not cover all forms of algorithmic bias.

Second, the bill lacks an avenue for meaningful public input. Technology companies often lack diverse voices and fail to adequately consider social impact, resulting in numerous fiascos — from Google’s image recognition algorithm that classified black people as gorillas, to Amazon’s job-recruiting engine that discriminated against women. In the United States, the typical impact assessment process, based on environmental law, includes an opportunity for public comments, but this bill would not require them.

Third, the proposal needs to mandate at least some public transparency for the results of impact assessments. If the results of assessments aren’t public, we can’t learn anything from them. The bill is missing a way for insights to make their way back into broader policy discussions. For example, a common question about algorithmic bias is whether it is worse than human decision-making. Impact assessments can be a tool to help society figure this out — but not if they are kept secret.

It was proven that algorithms behind many social media platforms were manipulated in an attempt to influence black voters. The released Mueller report outlined it plainly: Russian operatives deliberately targeted black activists online through social media—using the algorithmic technology behind online platforms to purposely cause dissension among black voters in the 2016 election (on page 32 of the Special Counsel’s report).

According to a report from Axios, these foreign actors gamed a number of tech platforms in addition to social media, including Google, PayPal, and Instagram.

“One of the reasons social media platforms continue to be exploited is because the opacity of algorithms being used make many of these fictitious posts or misleading campaigns go viral,” according to the Axios report.

A new study shows that leading AI models are 1.5 times more likely to flag tweets written by African Americans as “offensive” compared to other tweets.

Platforms like Facebook, YouTube, and Twitter are banking on developing artificial intelligence technology to help stop the spread of hateful speech on their networks. The idea is that complex algorithms that use natural language processing will flag racist or violent speech faster and better than human beings possibly can. Doing this effectively is more urgent than ever in light of recent mass shootings and violence linked to hate speech online.

But two new studies show that AI trained to identify hate speech may actually end up amplifying racial bias. In one study, researchers found that leading AI models for processing hate speech were one-and-a-half times more likely to flag tweets as offensive or hateful when they were written by African Americans, and 2.2 times more likely to flag tweets written in African American English (which is commonly spoken by black people in the US). Another study found similar widespread evidence of racial bias against black speech in five widely used academic data sets for studying hate speech that totaled around 155,800 Twitter posts.
