The now former Kenilworth schools superintendent accused of repeatedly pooping at a high school track near his home has notified Holmdel police he plans to file a lawsuit over the mug shot taken after his arrest, according legal documents filed by his attorney.
Thomas Tramaglini claims Holmdel police should not have photographed him at police headquarters because the public defecation, lewdness and litter charges, which remain pending, were low-level municipal offenses.
"It’s like getting photographed and fingerprinted for a speeding ticket," his attorney Matthew Adams said in an email to NJ Advance Media.
A speeding ticket? Maybe if it was joe schmoe. But it seems very ironic that this was in fact the superintendent of schools, and he's essentially vandalizing school property. I highly doubt this is because he couldn't find a toilet to relieve himself.

"On May 1, 2018, officers or agents of the Holmdel Police Department unlawfully took Dr. Tramaglini's photograph and distributed and disseminated the 'mug shot' to third parties, including the media with the intent to harm Dr. Tramaglini," according the court filing.
The filing, known as a tort claim notice, by Tramgalini is a required legal step in advance of a full lawsuit. It lists potential damages of more than $1 million due to loss of income, harm to his reputation, emotional distress and invasion of privacy.

If the practice is that the PD usually just tickets these offenses, then he might have a case and I hope he wins.

It usually happens to more vulnerable people, but the police practice of arresting or threatening an arrest for a very minor or dubious charge just so the booking info gets on the net isn't rare. I'd like to see there be a high profile case where a department gets sued for this bullshit.

At least here, there are rags that collect and publish these. Called "see who's locked up" or some such. They basically publicize your mug shot and alleged crime even after resolution unless you cut them a check.

So yeah, he has a point.

Maybe off topic, I was called into a federal judges chamber with prosecutors to explain why in my opinion the laws against cannabis were in fact bullshit. I was not seated on the jury.

I was part of a Jury pool for a case involving an acupuncturists and acupuncturist, and I when asked by one of the lawyers (it was a civil case, not sure which side) I took issue with the profession and its practitioners and was excused immediately. Wasn't trying to get kicked off.

I have many questions. What is the difference between "hermaphroditic misconduct" and regular misconduct? Is that a clear enough idea that it could be subverted by inauthentic mimicry?
